1. General


Article 1 In order to strengthen the management of cascade utilization of power batteries for new energy vehicles, improve the level of comprehensive utilization of resources, ensure the quality of cascade battery products (hereinafter referred to as cascade products), and protect the ecological environment, in accordance with the Law of the People’s Republic of China on the Prevention and Control of Environmental Pollution by Solid Waste The \"Recycling Economy Promotion Law of the People's Republic of China\" and the \"Interim Measures for the Administration of the Recycling and Utilization of Power Batteries for New Energy Vehicles\" (hereinafter referred to as the \"Administrative Measures\") are hereby formulated.


Article 2 The term \"cascade utilization\" as mentioned in these Measures refers to the process of necessary inspection, classification, disassembly, battery repair or reorganization of used power batteries into a stepped product so that it can be applied to other fields.


The tiered utilization enterprises mentioned in these Measures refer to the enterprises engaged in the production of tiered products. The definitions of recycling enterprises and waste power batteries in the \"Administrative Measures\" apply to these Measures.


Article 3 These Measures are applicable to the management of the echelon utilization related behaviors of the echelon utilization enterprises and other relevant market entities within the territory of the People's Republic of China (except for Taiwan, Hong Kong and Macau).


Article 4 The cascade utilization enterprise shall perform its main responsibility, follow the concept of the whole life cycle, implement the extended producer responsibility system, ensure the quality of the cascade products produced by the enterprise, and standardize recycling and environmental protection after scrap; the power battery manufacturer shall adopt easy The product structure design of echelon utilization is conducive to its efficient echelon utilization.


Article 5 The Ministry of Industry and Information Technology shall be responsible for the management, guidance and coordination of the utilization of power batteries across the country. The Ministry of Ecology and Environment, the Ministry of Commerce, and the State Administration of Market Supervision shall supervise and manage the use of power batteries within their respective responsibilities, and strengthen information sharing.


All provinces, autonomous regions, municipalities directly under the Central Government and Xinjiang Production and Construction Corps will coordinate with the competent departments of ecological environment, commerce, and market supervision at the same level to coordinate the guidance, supervision and management of the use of tiers in the region.


Article 6 The Ministry of Science and Technology supports the development, promotion and application of key common technologies and equipment in the cascade use, guides the collaboration of industry, university, research and application, and encourages the use of cascade use of new business model innovation and demonstration projects.


2. Requirements of tiered utilization enterprises


Article 7 Echelon utilization enterprises shall meet the relevant requirements of the \"Industry Standards and Conditions for the Comprehensive Utilization of Waste Power Batteries for New Energy Vehicles\" (Ministry of Industry and Information Technology Announcement No. 59, 2019). Encourage the use of advanced and applicable technology and equipment to package (group) and module-level echelon utilization of waste power batteries.


Article 8 Encourage cascade utilization enterprises to develop and produce cascade products suitable for base station backup, energy storage, charging and replacement, etc., and not to develop power banks, handheld lighting equipment and other cascade products that are not easy to recycle. Encourage the adoption of business models such as leasing and large-scale utilization that facilitate the recycling of cascaded products.


Article 9 Encourage cascade utilization enterprises to cooperate with enterprises in the production of new energy vehicles, production of power batteries, and recycling and dismantling of end-of-life vehicles, strengthen information sharing, use existing recycling channels, and efficiently recycle used power batteries for cascade utilization.


Article 10 When cascading utilization enterprises engage in cascading utilization of waste power batteries, they shall coordinate with new energy vehicles and power battery manufacturers to resolve intellectual property issues in accordance with relevant national regulations.


Article 11 Encourage cascade utilization enterprises to obtain the factory technical specification information, charging rate information of power batteries, and monitoring data information (voltage, temperature, SOC, etc.) specified by relevant national standards, and evaluate the residual value of used power batteries in combination with actual test data , Improve the efficiency of cascade utilization, improve the performance, reliability and economy of cascade products.


Article 12 A cascade utilization enterprise shall standardize the development of cascade utilization, have a cascade product quality management system and necessary inspection equipment and facilities, pass the quality management system certification, and adopt cascade product inspection rules and methods that meet the requirements of relevant standards. The production and sales of cascade products bear the responsibility of warranty and after-sales service.


Article 13 Echelon utilization enterprises shall establish a traceability management system, apply for manufacturer codes and record coding rules in accordance with relevant national traceability management regulations, and submit to the new energy vehicle national monitoring and power battery recycling traceability integrated management platform (www.evmam-tbrat. com) Upload related traceability information such as echelon products, waste power batteries, etc., to ensure that traceability information is uploaded in a timely, true and accurate manner.


3. Requirements for Echelon Products


Article 14 The design of cascade products shall comprehensively consider factors such as electrical insulation, flame retardancy, thermal management, and battery management to ensure the reliability of cascade products; adopt structures and connection methods that are easy to maintain, disassemble and disassemble to facilitate their scrapping Dismantling, dismantling and recycling afterwards.


Article 15 Echelon products shall undergo performance test verification, and their electrical performance, safety and reliability, etc. shall meet the requirements of the nominal capacity, nominal voltage and relevant national standards in the field of application.


Article 16 Echelon products shall have commodity bar code identification, and shall be uniformly coded in accordance with the \"Automotive Power Battery Coding Rules\" (GB/T34014), and the tier product identification shall indicate (but not limited to) the nominal capacity, nominal voltage, and tier utilization Company name, address, product origin, product implementation standard, traceability code and other information, and retain the original power battery code.


Article 17 The instructions for use of cascade products or other accompanying documents shall remind the cascade products of the relevant matters and requirements that should be paid attention to in the process of use protection, operation monitoring, inspection and maintenance, and scrap recycling.


Article 18 Echelon products should adopt appropriate packaging protection methods according to product characteristics, and packaging and transportation should comply with relevant standards such as \"Management Regulations for Recycling and Utilization of Vehicle Power Batteries Part 1 Packaging and Transportation Regulations\" (GB/T38698.1).


Article 19 The General Administration of Market Supervision, together with the Ministry of Industry and Information Technology, establishes a voluntary certification system for cascade products. The certified cascade products can use the cascade battery product mark on the product and packaging (see appendix).


4. Recycling requirements


Article 20 Enterprises using cascades should follow the relevant requirements of the \"Guidelines for the Construction and Operation of New Energy Vehicle Power Battery Recycling Service Networks\" (Announcement No. 46, 2019 of the Ministry of Industry and Information Technology of the People’s Republic of China) to establish a match with product sales. For the recycling service outlets of scrapped products, submit the information of the recycling service outlets and publish it to the public on the corporate website. Encourage cascade utilization enterprises to cooperate with new energy vehicle manufacturers to jointly build and share recycling systems to improve recycling efficiency.


Article 21 The cascade utilization enterprise shall standardize the recycling of the scrapped power batteries and the scrapped cascade products produced during the production and testing of the enterprise’s cascade products, and in accordance with the requirements of the \"Administrative Measures\", centralized storage and transfer to the recycling enterprise for disposal, and shall not be discarded at will Or dispose of and implement information disclosure work in accordance with relevant national requirements.


Article 22 The owner of the cascade product shall transfer the discarded cascade product to the recycling service network established by the cascade utilization enterprise or the recycling enterprise for standardized treatment, and shall not discard or dispose of it at will.


Article 23 The cascade utilization enterprise, the owner of the cascade product, etc., shall bear corresponding responsibilities if they dismantle, dismantle the discarded cascade product without authorization, or transfer it to another third party, which causes an accident.


Five, supervision and management


Article 24 The local industry and informatization authorities at or above the county level, together with the relevant authorities at the same level, shall supervise and inspect the production and traceability of the cascade products of the cascade utilization enterprises to ensure the standardized and efficient development of the cascade utilization.


Article 25 The competent local market supervision department at the county level or above shall supervise the quality of cascaded products in accordance with the requirements of the National Product Quality Law and mandatory standards, and pass the national enterprise credit information publicity for relevant administrative penalties, random inspection results and other enterprise-related information The system will be announced according to law.


Article 26 The local ecological and environmental authorities at or above the county level shall supervise the environmental pollution prevention and control of the production of cascade utilization enterprises and the utilization and disposal of discarded cascade product recycling enterprises in accordance with their duties. Deal with relevant laws and regulations.


Article 27 Local commerce authorities at or above the county level, together with relevant authorities at the same level, shall supervise and manage the dismantling, sale of power batteries, and entry of power battery information by scrapped motor vehicle recycling and dismantling enterprises in accordance with relevant national regulations.


Article 28 The Ministry of Industry and Information Technology, in conjunction with relevant departments, organizes the establishment of a New Energy Vehicle Power Battery Echelon Utilization Management Technical Committee, which is responsible for coordinating major technical issues in the process of new energy vehicle power battery echelon utilization management, and supports the formulation of relevant policies, Industry information analysis and other work.


Article 29 Any organization or individual has the right to lodge a complaint and report to the relevant departments for violations of the provisions of these Measures.


Six, supplementary provisions


Article 30 The Ministry of Industry and Information Technology, the Ministry of Commerce and Technology, the Ministry of Ecology and Environment, the Ministry of Commerce, and the State Administration for Market Regulation are responsible for the interpretation of these Measures.


Article 31 These Measures shall be implemented 30 days after the date of issuance.
